Terms of Service

1. Provider Information

Copilote AI Business is a B2B SaaS platform that helps restaurants recover lost revenue through AI diagnostics, automated marketing campaigns, review management, customer reactivation, menu pricing insights and competitive intelligence.

2. Account Registration

To use the Platform you must create an account and provide accurate, complete information. You are responsible for keeping your credentials confidential and for all activity under your account.

You must be at least 18 years old and have authority to bind the business you represent. The Platform is intended for business (B2B) use only.

3. Subscription Plans and Pricing

We offer the following monthly subscription plans:

• Starter: CHF 149 or EUR 149 per month — 1 restaurant, 500 emails/month, 200 SMS/month
• Growth: CHF 279 or EUR 279 per month — up to 3 restaurants, 2,000 emails/month, 800 SMS/month
• Pro: CHF 449 or EUR 449 per month — unlimited restaurants, unlimited emails and SMS

Prices are charged in Swiss Francs (CHF) for accounts registered in Switzerland or Liechtenstein and in Euros (EUR) for accounts registered in supported European countries. All prices exclude applicable taxes. The billing currency is determined by your registered account country. The prices shown on our public pricing page at the time of subscription are the prices applied at checkout.

4. Free Trial

New subscriptions include a 14-day free trial. The trial starts when you activate a plan through our secure Stripe checkout; a valid payment method is required at that point. No charge is made during the trial. Unless you cancel before the end of the trial, your subscription starts automatically and the first monthly fee (plus the onboarding fee, where applicable) is charged.

You may also create a free account without activating a plan to explore the AI diagnosis with limited features; no payment method is required in that case.

5. Onboarding Fee

A one-time onboarding fee of CHF 299 (or EUR 299 for European accounts) is charged when your first paid subscription starts. It covers account setup, initial configuration and the first revenue audit. The onboarding fee is non-refundable once setup has been initiated. It may be waived under specific promotional programs (see our Refund Policy).

6. Billing and Payment

• Subscriptions are billed monthly in advance on a recurring basis.
• Payment is processed by Stripe, a PCI-DSS compliant payment processor. We never store your card number.
• You authorize us to charge your payment method on file for all applicable fees.
• If a payment fails, we may retry it and suspend access until payment is resolved.
• Prices may change with at least 30 days’ prior written notice; changes apply from your next billing period.

7. Cancellation

You may cancel your subscription at any time from your account (Billing section) or by contacting hello@copilotebusiness.ai. Upon cancellation:

• Your subscription remains active until the end of the current billing period.
• No refunds are provided for partial months or unused time (see Refund Policy for exceptions).
• Your data is retained for 30 days after account deletion, after which it may be permanently deleted.

8. AI-Generated Content and Results Disclaimer

The Platform uses artificial intelligence to generate diagnostics, recommendations, campaigns and analytics. These outputs are decision-support tools only. We do not guarantee any specific revenue, profit, customer-acquisition or business outcome.

Figures shown in the Platform (e.g. recoverable revenue, projections, scores) are indicative estimates based on the data available and on statistical models. They are not promises of results.

You are responsible for reviewing and approving AI-generated content before it is sent to your customers or acted upon.

9. Communication Services

The Platform can send emails (via Twilio SendGrid) and SMS (via Twilio) on your behalf to your own customers. By using these features you confirm that:

• You have obtained the required consent from your customers to receive such communications.
• You comply with applicable anti-spam and data-protection laws (including GDPR, the Swiss FADP and CAN-SPAM where relevant).
• You are solely responsible for the content sent through the Platform.

10. Intellectual Property

All rights, title and interest in the Platform — software, design, algorithms, documentation — belong to Copilote AI Business. You receive a limited, non-exclusive, non-transferable licence to use the Platform for the duration of your subscription.

Content and data you upload (customer lists, menu items, restaurant data) remain your property. You grant us a limited licence to process this data solely to provide the Platform services.

11. Service Availability

We aim for high availability but do not guarantee uninterrupted operation. Planned maintenance and third-party outages (payment, email, SMS or AI providers) may temporarily affect the service. See our Refund Policy for extended-outage remedies.

12. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided "as is" without warranties of any kind, express or implied.
• We are not liable for indirect, incidental, special, consequential or punitive damages.
• Our total liability shall not exceed the fees you paid in the 12 months preceding the claim.
• We are not responsible for revenue losses, missed campaigns or business outcomes resulting from use of, or inability to use, the Platform.

13. Termination

We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or use the Platform in a harmful, fraudulent or illegal manner. Upon termination your licence to use the Platform ends immediately.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland. Any dispute is subject to the exclusive jurisdiction of the courts of Geneva, Switzerland, subject to any mandatory consumer or local law provisions that may apply.

15. Changes to These Terms

We may modify these Terms. Material changes are communicated by email or in-app notification at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
